1. Acceptance of terms
By installing or using ZS Smart Content ("the Service") provided by Zilancer ("we", "us", "our"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.
2. Description of service
ZS Smart Content is a Shopify app that generates AI-powered content (product descriptions, blog posts, SEO copy, translations, emails, social captions) for your Shopify store. The Service uses ZS Smart Content (ZSI) API to generate content.
3. Eligibility
You must be at least 16 years old and have legal capacity to enter into agreements. You must have an active Shopify store. You must comply with Shopify's terms of service in addition to ours.
4. Account & security
- You are responsible for all activity under your account
- You must keep your Shopify admin credentials secure
- Notify us immediately of any unauthorized use
- One account per Shopify store (multi-store discounts available — contact us)
5. Subscription & billing
- Free plan is free forever, with usage limits
- Paid plans bill via Shopify's billing API
- Charges appear on your Shopify invoice
- Subscriptions auto-renew until cancelled
- You can cancel anytime from the Billing page
- Cancelled subscriptions remain active until end of period
- Annual plans pay upfront for 12 months (20% discount)
- We may change pricing with 30 days notice — existing subscribers keep their rate until renewal
6. Acceptable use
You may NOT use the Service to:
- Generate content that violates Shopify's prohibited products policy
- Generate misleading, fraudulent, or false content
- Generate content promoting hate, violence, or illegal activities
- Generate adult/sexual content for products that are not legal adult products
- Scrape, copy, or resell our service or AI outputs at scale
- Attempt to reverse-engineer our prompts or system
- Circumvent usage limits via multiple accounts
- Abuse the AI to extract harmful instructions or content
Violation may result in immediate account suspension without refund.
7. Content ownership
You own what you generate. All content generated by the Service belongs to you and can be used for any commercial purpose. We claim no copyright on AI-generated outputs.
However, you acknowledge that AI-generated content may not be eligible for copyright protection in some jurisdictions, as it's machine-created.
8. Service availability
- We target 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance is announced 24h in advance via email
- We are not liable for downtime caused by OpenAI's API outages
- If our uptime drops below 99% in a month, Unlimited plan customers get prorated credits
9. Usage limits
Each plan has a monthly generation limit. When you exceed the limit:
- Generation is paused until next billing cycle
- OR you can upgrade your plan for immediate access
- Existing content is not affected
Unused credits do not roll over.
10. AI output disclaimer
AI-generated content is provided "as is". You are responsible for:
- Reviewing all output before publishing
- Ensuring factual accuracy
- Compliance with advertising laws in your jurisdiction
- Not making false claims about your products
We are not liable for damages caused by inaccurate AI output.
11. Modifications to service
We reserve the right to:
- Add or remove features
- Modify usage limits with 30 days notice
- Update these Terms with 30 days notice
- Discontinue the Service with 60 days notice (with prorated refunds)
12. Termination
You can cancel anytime by uninstalling the app from Shopify admin or canceling from the Billing page.
We may terminate your account if you:
- Violate these Terms
- Fail to pay subscription fees
- Engage in abusive behavior toward our team or community
13. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our maximum liability is capped at the amount you paid us in the last 12 months
- We are not liable for lost profits, lost data, or business interruption
14. Indemnification
You agree to indemnify and hold harmless Zilancer from any claims arising from:
- Your use of the Service
- Content you generate and publish
- Your violation of these Terms
- Your violation of third-party rights
15. Governing law
These Terms are governed by the laws of Bangladesh. Any disputes will be resolved in the courts of Dhaka, Bangladesh. EU users retain their statutory consumer rights.
